Requesting to Delay Rebuilding until Police Complete Investigations

The National Shoora (Consultative) Council (NSC), a grouping of several national level Muslim Organisations has issued the following statement on the move to rebuild damaged properties in the recent violence in Aluthgama:

The sudden moves to clean up and rebuild properties damaged by violence in Aluthgama, Beruwala and neighboring areas will destroy evidence that will be vital to be established for the police to complete investigations, required of them according to the Code of Criminal Procedure Act and related laws, so that perpetrators of crime do not benefit from the urgency of the authorities to rebuild the affected premises.

Representations have been made to us by persons from the area that the police have not visited the damaged houses, shops or mosques and recorded their own notes of the nature and extent of criminal offences committed in respect of persons and each of the properties. The law underscores the need to recover and record physical and forensic evidence at each crime site before they are destroyed. For instance, the Government Analyst needs to rule out that the arson committed on shops and houses were not due to electrical short circuit.

All this can be completed within one week, if a hundred police officers are deployed on the job immediately, with strict instructions to complete the legal requirements according to the time frame. This will also ensure that the international community is not given grounds to accuse the government of collaborating with criminals by clearing the debris, without completing investigations. In the circumstances, rebuilding process could be addressed upon duly concluding police investigations.

We decry attempts to portray the unprecedented attack on the Muslim community of the province as an insignificant incident or as a clash between two local groups or one initiated by the area Muslims, all of which are untrue and deeply hurting the community, as ugly as the violence. The insignificance, if at all lies in a private incident that occurred on 12^th June, between two drivers of the two communities being hijacked by the Bodu Bala Sena (BBS) to launch a major anti- Muslim campaign in the area on 15^th June, within three days of the original event.

While appreciating the condemnations issued across the board by all concerned groups, we condemn the move to blame violence on so called Muslim ‘extremism’, as if violence on such false reasoning is justified.

At the magisterial inquiry on Thursday, June 26, 2014, into the murder by shooting of three Muslims during the attack, it has transpired that STF personnel were present at the scene from which direction the firing occurred and that soon after the shooting the STF personnel came up and spoke to some amongst the victims. The government is duty bound to find out who were the STF personnel on duty at the scene of this crime and duly assist the inquiry in court.

ඔහු මෙසේ පැවසුවේ ඊයේ දිනයේ උතුරු පළාත් සභා සැසිවාරය අමතමිනි.

පසුගියදා අලූත්ගමදී එල්ල වූ අකාරයේ වූ ප‍්‍රහාරයන්ගෙන් බේරීම සඳහා සුළු ජාතිකයින් වන දෙමළ හා මුස්ලිම් ජනතාව එක්ව ජීවත් විය යුතු යයිද කී මහ ඇමතිවරයා උතුරු පළාතට පොලිස් බලතල නොදෙන බවට පවසන ආණ්ඩුව අද සිංහල ජනතාව අත පොලිස් බලතල තිබියදී මුස්ලිම් ජනතාව හිංසනයට ලක් කරන බවත් මෙම හේතුවෙන්ම උතුරු පළාත් සභාවට පොලිස් බලතල ලබාදෙන ලෙස ඉල්ලා සිටින බවත් කීය.

පසුගියදා අලූත්ගම දර්ගා නගරයේදී ඇතිවූ ගැටුම් අතරතුර මැණික් හා ස්වර්ණාභරණ අලෙවිසැල් කොල්ලකෑ පුද්ගලයන් සිවුදෙනෙකු පොලීසිය විසින් අත්අඩංගුවට ගෙන තිබේ.

රුපියල් ලක්ෂ 15කට ආසන්න වටිනාකමකින් යුත් ස්වර්ණාභරණද ඔවුන් සතුව තිබී සොයාගත් බව පොලීසිය පවසයි.

ඇල්පිටිය දර්ඝා නගරයේ සහ බේරුවල ප්‍රදේශ වල පසුගිය 15 වනදා සිටි හටගත් ගැටුම් සම්බන්ධවෙන් මේ වනවිට පුද්ගළයින් 50කට අධික පිරිසක් අත්අඩංගුවට ගෙන ඇත.

අලුත්ගම දර්ගා නගරයේදී භික්‍ෂුන් වහන්සේ නමකට පහරදීමේ සිද්ධිය මුල්කර ගනිමින් ඇති වූ ගැටුම සම්බන්ධයෙන් මෙතෙක් ආගමික විශේෂ පොලිස් ඒකකයට කිසිදු පැමිණිල්ලක් ලැබී නැත.

එම ගැටුම දෙපාර්ශ්වයක් අතර ඇති වූ සිදුවීමක් මිස ආගමික ගැටුමක් නොවන බවත්, එසේ වුවත් ආගමික විශේෂ පොලිස් ඒකකයට ඒ පිළිබඳ පැමිණිල්ලක් ලැබුණේ නම් එය අදාළ පොලිස් ස්ථානයට යොමු කිරීමට පියවර ගන්නා බවත් එම පොලිස් ඒකකයේ ඉහළ නිලධාරියෙක් "මව්බිම"ට කීය.

බුද්ධශාසන හා ආගමික කටයුතු අමාත්‍යංශ ලේකම් එම්.කේ.බී. දිසානායක මහතාගෙන් කළ විමසීමකදී ඒ මහතා ප්‍රකාශ කළේ එම ගැටුම ආගමික ප්‍රශ්නයක් නොවන බවත් පොලිස්පති ඇතුළු බලධාරීන් එම ගැටුමේදී මැදිහත් වූ බැවින් නැවැත ආගමික පොලිස් ඒකකයට ඒ පිළිබඳව පැමිණිලි කිරීම අවශ්‍ය නොවන බවත්ය.

මෙම ගැටුම පිළිබඳ චෝදනා එල්ලවෙමින් තිබෙන සංවිධාන සඳහා තමන්ට කිසිදු ක්‍රියාමාර්ගයක් ගත නොහැකි බවත් එය සාමාන්‍ය නීතියෙන් ගතයුතු ක්‍රියාමාර්ගයක් බවත් ලේකම්වරයා වැඩිදුරටත් කීය.

අලුත්ගම සිද්ධියට අදාළ පොලිස් විමර්ශන පිළිබඳ විශ්වාසය තැබිය නොහැකි බව පවසන ශ්‍රී ලංකා මුස්ලිම් කොංග්‍රසය ඒ සඳහා ජනාධිපති විමර්ශන කොමිසමක් පත්කරන ලෙස රජයෙන් ඉල්ලා සිටී. අලුත්ගම සිද්ධියේදී පොලිසිය හා විශේෂ කාර්ය බළකාය සම්බන්ධයෙන් එම පළාතේ මෙන්ම තම පක්‍ෂයේද විශ්වාසය බිඳවැටී ඇති බව කී මුස්ලිම් කොංග්‍රසයේ මහ ලේකම් හසන් අලී මහතා ජනතාවට සිද්ධිය පිළිබඳ සත්‍ය තොරතුරු ලබාදිය හැක්කේ කොමිසමකට පමණක් බවද කියා සිටී.
එම කොමිසමට තම නිර්දේශ ජනපති වෙත ලබාදීමට මාසයක් වැනි නිශ්චිත කාලයක් ලබාදිය යුතුව ඇතැයිද ඒ අනුව ජනාධිපතිවරයා නිසි ක්‍රියාමාර්ග ගනු ඇතැයිද තමන්ට විශ්වාස කළ හැකි යැයිද ඒ මහතා සඳහන් කළේය.

උදාහරණයක් ලෙස අලුත්ගම සිද්ධියේදී පොලිස් වෙඩි වැදී මරණයට පත් මුස්ලිම් ජාතිකයන් දෙදෙනාට මරණ සහතික නිකුත් කොට ඇත්තේ පිහි පහර වැදී මියගියාම බව සඳහන් කරමින් බැවින් එවැනි වාතාවරණයක් තුළ පොලිසිය පිළිබඳ අලුත්ගම ජනතාවට තිබූ විශ්වාසය බැඳවැටී ඇති බවද මහ ලේකම්වරයා පෙන්වා දුන්නේය.
