  • Dr. Shafi donates arrears of his salary to purchase medicines for hospitals
    Dr. Shihabdeen Mohamed Shafi, the doctor at the Kurunegala Teaching Hospital has decided to donate arrears of his salary amounting over Rs. 2.67 million for the purchase of essential medicines for hospitals.

    Dr. Shafi who was on compulsory leave on charges of performing infertility surgery, has received a cheque of over Rs. 2.67 million salary arrears from the Health Ministry last week.

    The salary arrears include the basic salary, interim allowance, cost of living, and allowance in lieu of pension for the period of compulsory leave imposed on Dr. Sihabdeen.

    Dr. Shafi who was employed at the Kurunegala teaching hospital was arrested on May 25th, 2019, on charges of performing infertility surgery.

    The Court of Appeal today ordered to release Attorney-at-law Hejaaz Hizbullah on bail after nearly two years in detention and remand custody. The National Shoora (Consultative) Council (NSC) , a grouping of national level Muslim Organisations, including a cross –section of the community’s intelligentsia and activists is not surprised at the BoduBalaSena’s  (BBS) call to ban the NSC.  The call exposes the BBS as an anti-national project, dedicated to destroying centuries of peaceful amity and co-existence between the Sinhalese and the Muslims of this country by spreading hate, based on falsehood.

බේරුවල සහ අලුත්ගම ගැටුමෙන් මියගිය පුද්ගලයන් දෙදෙනාගේ මරණ පරීක්ෂණ වාර්තා පිළිබඳ බලවත් සැක සංකා මතු වෙන බව විපක්ෂ නායක
රනිල් වික්‍රමසිංහ මහතා පාර්ලිමේන්තුවේදී ඊයේ (08) ප්‍රකාශ කළේය. ස්ථාවර නියෝග 23/2 යටතේ ප්‍රශ්නයක් මතු කරමින් විපක්ෂ නායකවරයා තවදුරටත් මෙසේද කීය.අලුත්ගම සහ බේරුවල අවාසනාවන්ත සිද්ධීන් නිසා වැලිපිටිය ප්‍රදේශයේ දෙදෙනෙක් මරණයට පත් වුණා. මේ පිළිබඳව අප සංවේගය පළ කරමින්, විශේෂ කරුණක් පිළිබඳව මේ සභාවේ අවධානය යොමු කරවන්නට කැමතියි.
සිද්ධියේ ඇසින් දුටු බොහෝ දෙනෙක් පවසන්නේ මේ මරණ සිදු වූයේ වෙඩි තැබිම් නිසා බවයි. නමුත් මරණ පරීක්ෂණ වාර්තා මඟින් කියවෙන්නේ දරුණු කැපුම් තුවාල නිසා මරණයන් සිදු වූ බවයි. මෙම පරස්පර කතාවන් හේතුවෙන් බලවත් සැක සංකා මතු වෙනවා.
අධිකරණ අමාත්‍යවරයා පවසන පරිදි මරණ පරීක්ෂණ වාර්තාවන් පවා හොරට සකස් කරනවා නම් එය ඉතා දරුණු තත්ත්වයක්. එලෙසම මේ ඝාතනයන් පිළිබඳව පැවැත්වූ මහේස්ත්‍රාත් පරීක්ෂණය සම්බන්ධයෙන් මම මෙහිදී අවධානය යොමු කරන්නට කැමතියි. ඒ පරීක්ෂණය සඳහා නීතිපති දෙපාර්තමේන්තුවේ නියෝජනය තිබුණේ නෑ.
මෙම අවස්ථාවේ අගතියට පත් පාර්ශ්වය වෙනුවෙන් පෙනී සිටි නීතිඥ මහත්වරුන් වැදගත් කරුණක් පිළිබඳව අධිකරණයේ අවධානය යොමු කළා. ඒ රජයේ රස පරීක්ෂණ දෙපාර්තමේන්තුව විනාශයට පත් ස්ථානයන්ට මතෛක් කැඳවා නැති බවයි. විශේෂයෙන්ම ගින්නෙන් විනාශ වූ ස්ථානයන් වෙත රස පරීක්ෂකයන් කැඳවා ගින්නට හේතුව පරීක්ෂා කිරීම මුළු ලෝකයේම අනුගමනය කරන ක්‍රමවේදයක්. නමුත් මෙහිදී රසපරීක්ෂණ දෙපාර්තමේන්තුව කැඳවා නැතුවා පමණක් නොවෙයි එවන් පරීක්ෂණයක් සඳහා අවශ්‍ය සාක්ෂි සියල්ලම මැකී යන අයුරින් ගිනි ගත් ස්ථානයන්හි සියලු සුන්බුන් ඉවත් කොට, යළි පළිසකර කිරීමට හමුදාව යොදා තියෙනවා.
මේ නිසා මහේස්ත්‍රාත්තුමා මේ නඩුවට අදාළ ස්ථානය අවට සුන්බුන් ඉවත් කිරීම සහ පිළිසකර කිරීම තහනම් කරමින් නියෝගයක් නිකුත් කර තිබෙනවා. නමුත් අනෙක් සෑම තැනකම සාක්ෂි වසා දැමීමේ ක්‍රියාපිළිවෙත ක්‍රියාත්මක වන බව මේ සභාවේ අවධානයට ලක් කරන්න කැමතියි. මේ පසුබිම මත මම අධිකරණ ඇමැතිවරයාගෙන් මතු දැක්වෙන ප්‍රශ්න විමසන්නට කැමතියි.
1. වෙඩි උණ්ඩ පාවිච්චි කළ බවට සාක්ෂි ඔබ සතුව තිබෙනවාද
2. මරණ පරීක්ෂණ වාර්තාව නිසි අයුරින් සකස් නොකළ නිලධාරියාට විරුද්ධව ඔබ ගෙන ඇති පියවර මොනවාද
3. ඔබගේ අමාත්‍යාංශය යටතේ රාජකාරි කරන නිලධාරීන් පිටස්තර බලවේගයන්ට හා පීඩනයන්ට යටත්ව ක්‍රියා කිරීම මෙරට අධිකරණ පද්ධතිය බාල්දු කරලීමට වහල් වෙනවා නේද
4. අනාගතයේ එවැනි තත්ත්වයක් වළක්වාලීම සඳහා ඔබ ගන්නා පියවර මොනවාද
5. නීතිපති දෙපාර්තමේන්තුව මහේස්ත්‍රාත් පරික්ෂණයට සහභාගි නොවුණේ කවර හේතුවක් නිසාද
6. රජයේ රස පරික්ෂණ දෙපාර්තමේන්තු පරික්ෂණයකින් තොරව සුන්බුන් ඉවත් කරලීමේ ක්‍රියාදාමය ආරම්භ කළ අවස්ථාවේ, එය වැළැක්වීමටත් රජයේ රස පරීක්ෂකයන් කැඳවීමටත් අධිකරණ අමාත්‍යාංශය මැදිහත් නොවුණේ ඇයි

අලුත්ගම සහ බේරුවල ඇති වූ සිද්ධීන්ගෙන් හානියට පත් දේපළ ප්‍රතිසංස්කරණය කිරීමට හමුදාවට භාරදීමට ප්‍රථම එම ස්ථානයන්හි සාක්ෂි ඊට අදාළ අංශ විසින් ලබා ගෙන ඇතැයි අධිකරණ ඇමැති රාවුෆ් හකීම් මහතා පාර්ලිමේන්තුවේදී ඊයේ (08) ප්‍රකාශ කළේය.මේ සිද්ධිය වූ ස්ථානයට ගිය පළමු දේශපාලනඥයා තමන්  බවත් ගිනි ගැනීම් කිසියම් කණ්ඩායමක් විසින් සිදු කළ බවට ජනතාව ප්‍රකාශ කළ බවත් ඇමැතිවරයා සඳහන් කළේය. එම ප්‍රකාශයන් කිසිවෙකුත් ප්‍රතික්ෂේප නොකළ හෙයින් එම ස්ථානවලට රජයේ රස පරීක්ෂකවරයා ගෙන්වීමේ අවශ්‍යතාවයක් පැන නොනැගුණු බවද ඇමැතිවරයා පැවැසීය.
මෙම ස්ථානයන්හිදී සිදුවූ මරණ වෙඩි තැබිම් නිසා සිදුවූ ඒවා බවට ජනතාව තමා සමග පැවැසූ බව කී ඇමැතිවරයා මරණ පරීක්ෂණ වාර්තාව අනුව එහි යම් ප්‍රශ්නයක් පැන නගින බවද කීවේය. මරණ පරීක්ෂණ කටයුතු සඳහා නීතිපතිවරයා යොදා නොගැනීම සම්බන්ධයෙන් පිළිතුරු දෙනවා නම් අදාළ පරීක්ෂණ සඳහා මහේස්ත්‍රාත්වරයාට සහය ලබාදීමට ‍පොලීසියට හැකි බව ප්‍රකාශ කර ඇතැයිද ඇමැතිවරයා සඳහන් කළේය.
කෙසේ නමුත් එදින රාජකාරියේ සිටි ‍පොලිස් නිලධාරීන්ගේ ගිනි අවිද කොළඹ අපරාධ කොට්ඨාසයේ නිලධාරීන් භාරයට ගෙන ඇතැයිද ඔහු ප්‍රකාශ කළේය

ශ්‍රව්‍ය දෘශ්‍ය වාදනය

අධිකරණ භූමිය තුල නීතිවේදීන්ට තර්ජනය කිරීමෙන් සහ ගැටුම් ඇති කර ගැනීමෙන් වළකින මෙන් කොටුව මහේස්ත්‍රාත්වරයා බොදු බල සේනා සංවිධානයේ භික්ෂුන් වහන්සේලාට අවවාද කර තිබේ.

ශුද්ධ වූ කුරානයට අපහාස කිරීම සහ ජාතික බල සේනා සංවිධානයේ මාධ්‍ය සාකච්ඡාවට බාධා කිරීම යනාදී චෝදනාවලට අදාළව පැමිණිලි කැඳ වූ අවස්ථාවේදීයි එම සංවිධානයේ ලේකම් ගලගොඩ අත්තේ ඥානසාර හිමි ඇතුළු භික්ෂූන් වහන්සේලාට අධිකරණය විසින් මෙසේ අවවාද කරනු ලැබුවේ.

ඉදිරියේදී මෙවැනි පැමිණිලි ඉදිරිපත් වූවොත් දැඩි ක්‍රියාමාර්ග ගැනීමට සිදු වන බවට මහේස්ත්‍රාත්වරයා අනතරු අඟවා සිටි බවයි අගතියට පත් පාර්ශවය වෙනුවෙන් පෙනී සිටි නීතිවේදි මෛත්‍රී ගුණරත්න මාධ්‍යවලට කියා සිටියේ.

තර්ජනයක්

‘පසුගිය නඩු වාරයේ නඩුව අවසන් වී පිටතට පැමිණි ගලගොඩ අත්තේ ඥානසාර හිමි මා වෙත තර්ජනයක් කළා. ඒ පිළිබඳ මම පොලිසියට පැමිණිල්ලක් කළා. ඒ සම්බන්ධයෙන් පරීක්ෂණයක් පවත්වා වාර්තාවක් ඉදිරිපත් කරන මෙන් මහේස්ත්‍රාත්වරයා පොලිසියට නියම කළා’ යයි නීතිවේදි මෛත්‍රී ගුණරත්න පැවසුවේය.

‘නීතිවේදීන් උසාවියට සහාය වන නිලධාරීන් බව ප්‍රකාශ කල මහේස්ත්‍රාත්වරයා ඕනෑම නීතිවේදියකුට මතයක් දැරීමේ අයිතියක් තිබෙන බව කියා සිටියා.’ යයි නීතිඥ මෛත්‍රී ගුණරත්න වැඩි දුරටත් පැවසීය.

කුරානය

පොලිසිය අධිකරණයට වාර්තාවක් ඉදිරිපත් කරමින් කියා සිටියේ මෙම නඩුවලට අදාළ සිදුවීම් පිළිබඳ දර්ශන ඇතුළත් සංයුක්ත තැටිවල අඩංගු දත්ත වල නිරවද්‍ය භාවය පිළිබඳ සොයා බැලීම සඳහා මොරටුව විශ්ව විද්‍යාලය වෙත යොමු කර වාර්තාවක් ලබා ගැනීමට තීරණය කර ඇති බවයි.

ඒ අනුව අදාළ පැමිණිලි ලබන සැප්තැම්බර් මස පළමු වනදා කැඳවීමට නියම කල මහේස්ත්‍රාත් තිලින ගමගේ එදිනට පරීක්ෂණවල ප්‍රගතිය දැක්වෙන වාර්තාවක් ඉදිරිපත් කරන මෙන් පොලිසියට නියම කළේය.

නඩු විභාගය අවසන් වීමෙන් පසුව අදහස් දැක්වූ බොදු බල සේනා සංවිධානයේ ලේකම් ගලගොඩ අත්තේ ඥානසාර හිමියන් කියා සිටියේ කවර ආකාරයේ බාධක පැමිණියත් කුරානය පිළිබඳ තමා විසින් දක්වන අදහස් නතර නොකරන බවයි.

Aluthgama mayhem: Ranil alleges cover-up

Justice Minister Rauff Hakeem told Parliament yesterday that all police officers present in Alutgama during the recent ethnic violence had surrendered their weapons to the Colombo Crimes Division (CCD) investigating the incidents to prove that shots had not been fired from their weapons.


The minister, responding to a series of questions raised by UNP and Opposition Leader Ranil Wickremesinghe, said that ten empty shells had been found by the crime scene investigating officers and CCD officers and some of the suspects who fired the shots had been arrested.


"There are many eyewitnesses who state that both deaths occurred due to gunfire. However, post mortem says the deaths were caused by lethal cut wounds. These contradictory statements have brought about many misgivings," he said.


Minister Hakeem said the matter was under investigation and the Magistrate had summoned the JMO who conducted the post mortem to ascertain his views on the matter prior to giving an order to exhume the bodies.


Wickremesinghe making a special statement alleged that there seemed to be a cover-up of the incidents at Alutgama.


Full text of Wickremesinghe’s statement: Two persons died as a result of the unfortunate events that took place in Aluthgama and Beruwala. Expressing our sympathy on those deaths, I wish to draw the attention of this House on a special matter.


There are many eye witnesses who state that the deaths occurred due to gun fire.  However, post mortem states that the deaths were caused by lethal cut wounds.


These contradictory statements bring about many misgivings.


These misgivings are further confounded by the interview given by Rauff Hakeem, the Minister of Justice to a newspaper on 22nd June which states that,


"Although two people were shot dead in Welipitiya on Thursday, its inquiry and the post-mortem are strange.  I can submit proof that bullets had been used at the spot where these people were wounded.  I went to the spot.  It is not the civilians who fired at them.  But the post mortem report states that those two were dead due to lethal cut wounds.  It is a very serious matter if even the medical reports are prepared fraudulently".


As the Minister of Justice himself states, it is a very serious matter if even the medical reports are prepared fraudulently.


I also wish to draw your attention on the Magistrate’s inquiry conducted on these killings.  That inquiry had no representation from the Attorney General’s Department.


The Counsels appearing for the affected party drew the attention of the Court on an important matter where they stated that the Government Analyst had not yet been called to the locations. In particular, it is a methodology followed worldwide to summon the analysts to the locations destroyed by fire and determine their cause. However, in this instance, not only the Department of Government Analyst had not been called, but also the armed forces had been deployed to remove all the debris and renovate all such spots that caught fire so that every proof that would support such an inquiry would be rubbed out.


Therefore, the Magistrate has issued an order banning removal of debris around the spot concerning this case and the related renovations.  However, I would like to bring to the notice of this House that the process of concealing proof is underway everywhere else.


Against this backdrop, I wish to ask the following questions from the Minister of Justice: Are there evidence available that bullets were used? What are the steps you have taken against the officer who did not prepare the post mortem report properly? Is not the state of the officers who perform their duties under your Ministry subject to influence and pressure from outside amount to a disparagement of the judicial system of this country? What are the steps you intend to take to prevent recurrence of such a situations in future? What was the reason for the Attorney General’s Department to distance itself from the magisterial inquiry? When the process of removing debris without an inquiry by the Department of Government Analyst was started, why did not the Ministry of Justice intervene to prevent it and summon the Government Analyst?

Hate Speech Laws May Threaten Freedom Of Speech

The government has called for legislators to draft laws which deal with certain areas of social media in order to curb hate speech and has declared that it will take stern action against those who use social media to promote communal and religious hatred. In the wake of the incident at Aluthgama, many see the need to take action against those who practice hate speech and incite communal violence.

However, concerns are being raised that this move by the government may restrict people from criticizing the government, thereby violating the freedom of speech and expression of the people. In the meantime some lawyers of the Bar Association of Sri Lanka observed that with the current trend of the government putting pressure on traditional media and banning many independent websites, social media has been the only form of information – and restrictions on using social media will violate the public’s right to access information.

President of the Bar Association Upul Jayasuriya told The Sunday Leader that the government has failed to let the media act independently and the move towards restricting social media users is seen as another form of curbing people’s access to information. He added, “With reference to media freedom, Sri Lanka is placed at 173 out of 178 countries in the world. Rwanda seems to have better freedom of expression than Sri Lanka as they are ahead of us in the list.” According to him, 37 journalists have so far fled the country this year as the government has failed to let the media act independently.

Commissioner of the Human Rights Commission of Sri Lanka (HRCSL) Dr. Prathiba Mahanamahewa added that Article No 14 (1) of the 1978 Constitution clearly recognizes freedom of expression, freedom of publication and freedom of the press. The government cannot arbitrarily censor any media programme because people have the right to receive information. But in the digital world, we receive plenty of information from websites. With social media if any incident occurs, within one second whole world will come to know without any barriers.”He explained that according to the European Union constitution in 2000, the digital rights of the citizens are protected.

He said, however by Article 15 of the 1978 Constitution, the freedoms of speech and publication are restricted – they are not recognized as absolute rights. Therefore he said that there are certain situations where the state can restrict those rights. He pointed out that even in the International Covenant on Civil and Political Rights, those restrictions are there and includes restrictions on disrupting religious harmony. According to Dr Mahanamahewa those restrictions should be imposed in a very accountable way accompanied by proper evidence and reasons.

He added, “Censoring a website is not like censoring the press. These websites are not operating from Sri Lanka; they are hosted in countries like Norway and Sweden, etc. Therefore, he added that the TRCSL can censor or ban them if such things happen. He added, “However, they must prove that it is under Article 15 of the Constitution. Otherwise, a citizen who is denied information from these websites can go to the Supreme Court citing an infringement of their fundamental rights”.

Dr Mahanamahewa gave an example of a case where an individual filed a case in the US Supreme Court against the banning of Al-Jazeera in the US. He pointed out that this particular individual won the case after proving that Al-Jazeera is the only website which provides true information on the Middle East and the US Supreme Court lifted the ban on Al-Jazeera. He added, “Any citizen has the right to go to court in order to protect their rights. On the other hand the Attorney General can decide whether those rights are absolute or restricted. We have to see if arbitrary censorship has been done only after analyzing evidence”. He pointed out that certain amendments to the US Patriot Act even allows law enforcement to search emails and telephone communications and even arrest certain suspects without a search warrant.

However Upul Jayasuriya added that Article 14 (1) of the Constitution of Sri Lanka recognizes media freedom and it is being cited as a fundamental right. He added that under the present regime the law seems to be only applicable to punish the poor and the ordinary whereas the rich and the powerful are not ruled by law.  He added that Article 15 of the Constitution refers to emergency situations and there are no emergency situations right now in the country. He said, “When there is a crisis in the country, Article 15 has some amount of a role to play. But we do not have an emergency situation at present”.

He pointed out that ‘hate speech’ is incorporated in Section 2 (1) of the Prevention of Terrorism Act and thereby it is prohibited for anybody to make any kind of speech that causes communal or religious disharmony – and therefore there is no need to bring in a separate Act. He said, “All what we need is the willingness of the law enforcement authorities and those who are giving orders to the law enforcement authorities to enforce the law”.

Dr Paikiasothy Saravanamuttu said that the existing law in the country if enforced impartially allows action against those who incite communal violence through hate speech. He added that the problem is that the government is not taking impartial action against those who are spreading communal and religious hatred. According to him, if the government is to take impartial action against those who incite religious and communal hatred, it should be done without violating the freedom of speech and expression. He emphasized that in extreme cases, necessary action must be taken.

Information Security Engineer at Sri Lanka Computer Emergency Response Team (CERT) Roshan Chandragupta told The Sunday Leader that CERT has been receiving certain complaints on social media.  He added that for the last six months they have received over 1050 complaints mostly about fake accounts and pictures. However, he said that CERT has not received complaints from anyone about social media being used to spread religious or communal hatred. He noted that social media including Facebook have their terms and conditions and people can report against particular account users for the content or pictures on their profiles under different categories.

He added that Facebook in particular has defined what they consider hate speech. Accordingly, content that attacks people based on their actual or perceived race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability or disease is considered ‘hate speech’ and not allowed on Facebook.

Thus, according to Chandragupta if any individual comes across such content they can report it to Facebook or other social media operators and if the complaint is found to be bona fide, the content will not be displayed and in some instances the profiles of the persons posting the hate speech will be blocked.

Meanwhile, Secretary to the Ministry of Mass Media Charitha Herath assured that according to his understanding the government does not intend to bring in new legislation, but is only planning to take action according to the existing laws. He added, “The existing laws have enough legal space even to minimize and eradicate hate speech and provide for the protection of people’s rights”

Majority Must Not Be Blamed For Aluthgama Violence

Government members and President Mahinda Rajapaksa no less, have seen a conspiracy in the anti Muslim riots that took place last month in Aluthgama.   The damaging view has gone abroad that Sinhalese have rioted against Muslims.  The short reports in the international media do not convey the full picture of what happened.

This has created an incorrect impression abroad of a Sinhalese-Muslim polarisation.  Aluthgama was the exception, not the norm.  Outside of Aluthgama, relations between Sinhalese and Muslims are largely amicable and peaceful coexistence is the norm.  It is not just these two communities, but also Tamils, Christians, Buddhists and Hindus who are all eager to be friends, and not permit communalism to enter between them.

Some months ago, I was passing through Darga Town, which borders Aluthgama, and where there has been a history of Sinhalese-Muslim tension.  There have been communal clashes there in the past.  We stopped at a grocery store to buy some bottles of water.  The Muslim shop owner was serving a Muslim customer. But when he saw us, a Sinhalese family, enter his shop, he excused himself and served us first. This action struck us then, but now in retrospect, I can surmise that he did this because he was conscious of the need to have good relations with the Sinhalese.  I see this same sentiment in the inter-religious groups I work with.   Those belonging to one religious persuasion go out of their way to please the other.   Their desire is for amity, not for confrontation.

After the Aluthgama riots, I was at a meeting where a Buddhist monk exclaimed in anguish, that an entirely wrong picture of the Buddhists has been given to the world.

He was not denying that the Aluthgama riots had taken place and that innocent Muslims had even been killed and their properties burnt.  He was merely trying to say that those who attacked the Muslims were not doing this with the consent of the Sinhalese masses.  These were small groups acting without the blessings of the larger society, although perhaps with the blessings of powerful elements in society, which is what has given them their vast power and immunity to attack as they will.  This is all the more tragic because the message that goes to the Muslims in Sri Lanka, and to the larger international community, is that the Sinhalese are attacking Muslims.

Violence of a few

Those who live outside of Sri Lanka, and those who are victims, are not so interested in the nuances of the situation.   Nor is the international media for the most part when they report what is happening. They tend to give only the broadest of outlines.  But in reality this is the violence of a few, to which the law enforcement authorities were being deferential.  It is the availability of impunity that drives the violent elements to more violence.

It is therefore surmised that the imperatives of electoral politics are what lie at the root of the failure of the government to check the violence.  The BBS is part of the government’s electoral alliance. If the Sinhalese voters feel insecure for any reason they will tend to vote for the present government which is seen as strong and pro-Sinhalese.
But the international costs are going to be high.  It is evident that the government is feeling the pressure on itself from both the affected Muslims and the larger international community.

The 57 members of the Organisation for Islamic Cooperation based in Saudi Arabia has expressed their serious concern and said that “the recent attacks appear to follow a rising trend of violence instigated by extremists which is spreading fear and mistrust among the population.”  There has been widespread condemnation of the police for failing to nip the riot in the bud, and for having permitted a public rally to be held by the BBS despite appeals by local community leaders not to permit it.

It is in this context of accusations directed against the government and the police that the Ministry of Defence has issued an unprecedented denial about having links with the BBS which stands accused of fomenting the riots.  This denial of any connection or involvement with the BBS is a welcome disassociation even if it comes late. In particular the Defence spokesperson has refuted the allegation that the Defense Secretary, who is counted as among the most powerful in the country, has any special relationship with the BBS.  He has also clarified that the Defense Secretary’s attendance at a public ceremony at which the BBS was also present, and which has generated much controversy, had nothing to do with any association with it.

Two requirements

The government’s affirmation of its commitment to peaceful relations between the communities and to ensure justice for all will be confirmed if two matters are addressed speedily.  The first is that an independent inquiry be held into what transpired in Aluthgama.  Such an inquiry panel may be selected with the participation of the Minister of Justice who is himself a Muslim and who has complained of misrepresentation of the causes of death of some of the victims of the riots.  The Judicial Medical Officer (JMO) who submitted the postmortem report on one of the victims killed during the Aluthgama violence has been summoned to court after his report was disputed. In these circumstances a credible fact finding body will be able to dispel the doubts as to what really happened at Aluthgama, and who paid the price.

The second requirement is that punitive action be taken against the instigators of the violence.  The police have now questioned the BBS leaders with regard to the speeches made prior to the riots.  They have also taken 117 persons into custody, with 85 of them being produced before courts and 25 being released on bail.  But these steps are unlikely to reassure the Muslims and other potential targets, so long as extremist groups are given a free hand to mobilise their members for action, at the time and place they choose. The violence in Aluthgama followed a sustained hate campaign against the Muslim community in the Aluthgama area and elsewhere in the country which has still to be countered by either legal or political means.

Small groups of extremists can create disturbances even though the ethos of the larger majority is to live in peace and harmony.  In these circumstances the fullest application of the law must be employed to quell any disturbance. It is the non-application of the law due to political interference that has made inter-ethnic and inter-religious relations within the country a potential point of conflict.  Inter community relations between Sinhalese and Muslims are currently not based on fear of each other, but this can change as it once did between the Tamils and others during the war.  The danger in permitting the situation to drift is that it can lead to radicalisation from which there will be no return.

Rajitha’s Lone Battle Against BBS

Minister Senaratne was a critique of the Bodu Bala Sena since its inception. The Minister once termed the organization as the armed wing of the ‘Buddha Sasana’. He was never hesitant to dub the organization as a ‘terrorist movement’ which had little or no regard for the core values of Buddhism

Fisheries Minister Rajitha Harischandra Senaratne is a tough politician in every sense of the word. When most of the government members were afraid to raise their voices over the conduct of the Bodu Bala Sena, Minister Senaratne took up the challenge to openly claim that the conduct of the BBS was suggestive of a terrorist group! He also said he was not afraid of any group and he had faced various political opponents throughout his long political career who were much stronger and more powerful than the BBS.
Senaratne’s history speaks volumes for his ‘metal’ and the manner in which he dealt with his political opponents.

Rajitha’s political opponents

Having graduated from the Faculty of Dental Science at the University of Peradeniya, Senaratne soon became the Secretary of the Government Dental Surgeons Association (GDSA), a union that was outspoken and powerful during the late 70s and early 80s. Senaratne, as a trade union activist who strongly supported leftist politics, was harshly critical of the J.R. Jayewardene government and its policies.

Rajitha Senaratne became a newsmaker when he joined Vijaya Kumaratunga to form the Sri Lanka Mahajana Party which emerged strongly in the early 80s as an alternative of some sort to the ‘traditional left’. However, when the JVP launched its armed struggle in 1987, the SLMP was one of its prime targets due to its opposing views when it came to the ‘national question’ and the setting up of Provincial Councils under the 13th Amendment.

When the JVP resorted to violence, Senaratne was a strong critique of its ‘eye for an eye, tooth for a tooth’ policy. As a result, armed JVP members were on a feverish mission to gun down the leftist dental surgeon. His colleagues Vijaya Kumaratunga and Dewabandara Senaratne were brutally killed by JVP gunmen in broad daylight.

During the Presidential election campaign in 1988, Senaratne was critically injured in a bomb blast at an election rally in Grandpass that was conducted to support Ossie Abeygunasekera’s election campaign. Although he underwent surgery following the attack, two pieces of shrapnel still remain in his skull. However, that never deterred Senaratne’s political career.

He contested the Western Provincial Council election in 1988 from the United Socialist Alliance of which the Sri Lanka Mahajana Party was a constituent partner. Having won the Provincial Council election he also contested the General Election in 1989 from the same Alliance, defying threats and ‘death warrants’ from the JVP. However, after the assassination of SLMP Founder Vijaya Kumaratunga, differences of opinion emerged between Kumaratunga’s successor Ossie Abeygunasekera and Senaratne. As a result of this internal dispute, Senaratne formed the ‘Bahujana Nidahas Peramuna’, the party which sheltered Chandrika Kumaratunga upon her return to Sri Lanka a few years after the death of her husband Vijaya Kumaratunga.

Subsequently, Senaratne joined the United National Party and the late D.B. Wijetunga appointed him as a national list Parliamentarian. During the General Election in 1994, Senaratne contested from the United National Party for the Kalutara District and secured a Parliamentary seat. He was a firebrand MP in the opposition from 1994 to 1999 and played a pivotal role in the debate over the Channel-9 scandal which was a major setback for the Chandrika Bandaranaike Kumaratunga government. He was also the first opposition Parliamentarian who openly questioned the ‘educational qualifications’ of the former President.

He was also the first politician in Sri Lanka who was unseated from Parliament by a court order. In 1999 the court disqualified him from doing business with the state and he was unseated from Parliament. Although he had to sacrifice his Parliamentary seat, the UNP reappointed him to the vacancy created by his own unseating. Senaratne has not lost his Parliamentary seat since 1994 and has been a member of the House for more than 20 years.

In 2007, he crossed over to the UPFA along with Karu Jayasuriya and 16 other Parliamentarians of the UNP. Ever since then he has been an influential minister in the ruling camp and headed important ministries such as the Land Ministry and the Fisheries Ministry. President Mahinda Rajapaksa has entrusted Senaratne with the task of handling the problem pertaining to Tamil Nadu and Sri Lankan fishermen which has become a major problem between Sri Lanka and India.

First salvo at BBS

Minister Senaratne was a critique of the Bodu Bala Sena since its inception. The Minister once termed the organization as the armed wing of the ‘Buddha Sasana’. He was never hesitant to dub the organization as a ‘terrorist movement’ which had little or no regard for the core values of Buddhism.

In response, General Secretary of the Bodu Bala Sena movement Galagodaaththe Gnanasara Thera ridiculed Minister Rajitha Senaratne while addressing a public meeting several months ago. Gnanasara Thera said he was a ‘Dentist’ who had no understanding of what he was talking about. He also urged the people of Kalutara to defeat the likes of Senaratne – who are not supportive of Sinhala-Buddhist organizations – in future elections

When the violence broke out in Beruwela and Aluthgama, Minister Senaratne was in the US, participating in a study tour at the invitation of the Harvard University to study international politics and leadership. Although he received reports on the violent clashes in his own constituency, he was not in a position to cut short his tour and return to the country. However, on his return he visited Beruwela, Aluthgama and Dharga Town, and was shocked when he saw the level of destruction caused by the anti-Muslim clashes.
Soon after his visit, he convened a press conference and lashed out at the perpetrators who were behind this violence.

“If I have committed a mistake, the law should be implemented against me too. It takes so many years to construct a city. But it would take only a few hours to destroy it. That is exactly what the goons have done. The hearts of the Muslims in the area have been shattered now. The only way we can heal the hearts of the Muslims is by implementing the law. The government should understand that. Police and security forces should be allowed to take action against the culprits,” he said.

Making another important revelation at the press conference, Minister Senaratne said a senior Police officer had informed him that the Criminal Investigations Department (CID) had launched an investigation into the speech made by the BBS General Secretary. It is widely alleged that it was this ‘infamous’ speech that incited violence in Beruwela, Aluthgama and Dharga Town.
However, it should also be noted that it took two weeks for the CID to initiate an inquiry into the Aluthgama violence which claimed at least six lives and injured scores.

Rajitha accuses the BBS of LTTE links

A few days after the statement made by Minister Senaratne, the CID contacted BBS General Secretary Gnanasara Thera and informed him that they wanted to record a statement from him over the clashes in Aluthgama. On July 2, Gnanasara Thera visited the headquarters of the Criminal Investigation Department at 1.30 p.m. and gave a four hour long statement to the Police of his version of the story.

In his statement, Gnanasara Thera completely distanced himself from the incident and said the BBS had no hand in the violence. He accused what he termed as Muslim extremist elements of inciting violence and said they wanted to trigger a clash between the Sinhalese and the Muslims.

However, another interesting development took place just a day after Gnanasara Thera gave his statement to the CID. Minister Rajitha Senaratne, in a radio interview, fired another cannon ball at the BBS saying its leaders had secret discussions with Tamil Diaspora members who were supportive of the LTTE.

He also said that UNP Parliamentarian Ravi Karunanayake ‘facilitated’ the meetings between the BBS and LTTE supporters. The Minister said he even had photographs to prove that the BBS stalwarts had met LTTE supporters of the Tamil Diaspora. He said that the BBS and its conduct was part of a larger international conspiracy to tarnish the image of Sri Lanka and further trap the country in allegations of human rights violations.

However, speaking to The Sunday Leader, UNP MP Ravi Karunanayake flatly denied the allegation that he facilitated a meeting between the BBS leaders and Tamil Diaspora members. He said he was not aware of any such meeting and had no connection whatsoever with either of the parties.

Gotabaya distances himself from BBS

While this controversy gained ground in the Sri Lankan media, Defence Secretary Gotabaya Rajapaksa categorically stated that he had no association with the Bodu Bala Sena.

Speaking to Sri Lankan website Ada Derana, the Defence Secretary said, “I have no affiliation with the Bodu Bala Sena (BBS) and I have never assisted them. Those with narrow political motives try to insinuate that I am behind every problem that surfaces between groups,” the Defence Secretary said.

“There are certain groups which are trying to create chaos in Sri Lanka at a time when the country is facing questions about human rights at the UNHRC. I have worked tirelessly towards bringing peace to Sri Lanka and will not stand idly by as people try to disrupt that peace,” he said. The same views were expressed by Army Spokesman Brigadier Ruwan Wanigasooriya who addressed a press conference in Colombo that same day.

President visits Beruwela again

Meanwhile, President Mahinda Rajapaksa too visited Aluthgama again to observe the progress of the work carried out by the Army to repair and restore the properties damaged during the anti-Muslim clashes on June 15 and 16. Most of the rebuilding work is presently being done under the guidance of the Sri Lanka Army. The President also spoke to people who were affected by the violence and they repeatedly told the President that the culprits came from ‘outside’!

During the inspection tour which took place on the sidelines of the workshop for ruling party MPs, the President met Sinhala and Muslim communities in Pathirajawela, Dharga Town, Warapitiya, Seenawatta, Aluthgama and several other areas. Rajitha Senaratne, Rohitha Abeygunawardena and Major General Ubaya Madawela accompanied the President on the tour.

The President also visited the Kande Viharaya in Aluthgama and had a discussion with the Chief Incumbent Venerable Batuwanhene Buddharakkitha Thero.

At the same time, the workshop organized in Beruwela gave a strong message to the country that the government was serious about its damage-control measures in the aftermath of the Aluthgama violence. The President, who had just returned from a four-day official visit to the Maldives and Seychelles, chaired the special workshop for all Ministers, MPs and Provincial Council members representing the Sri Lanka Freedom Party (SLFP).

The day-long workshop was held to discuss the new development projects launched by the government and the way forward. Treasury Secretary Dr P.B. Jayasundera, Central Bank Governor Ajith Nivard Cabraal and Professor Dhamma Dissanayake also spoke at the workshop and responded to questions posed by Ministers and MPs.

Addressing the workshop, President Mahinda Rajapaksa said the main opposition United National Party was gaining an advantage from the present controversy. “The UNP’s involvement in the plot to distance the Muslims from the government is clearly visible,” the President said.

“The Opposition Leader is famous for uttering a lie every week. At one point he said that a student is charged Rs 50,000 to be admitted to Mahindodaya laboratories by the government. He also launched a massive media campaign saying the International Monetary Fund has advised the government to slash the education budget. There was no element of truth in such allegations and all those attempts were directed at deceiving the people,” the President said.

“The UNP has grouped at village level to propagate lies against the government and was plotting to distance the Muslim community from the government. The opposition has set up a number of groups to create various opinions that are hostile to the government,” the President added.

However, anti-Muslim clashes and the emergence of extremist elements was a hot topic between ruling party representatives who took part in the workshop. Although some remained tight-lipped about the people who were instrumental in creating this situation, some vociferously stated that stringent action should be taken against those who were behind violence, overtly and covertly, regardless of their status.

My resignation letter not accepted: Thevarapperuma

UNP parliamentarian Palitha Thevarapperuma said Party’s National Leader Ranil Wickremesinghe refused to accept his resignation letter submitted to him in Parliament a short while ago.

A few weeks ago, Mr. Thevarapperuma said he would resign from his post as MP because he was disappointed that he was unable to do justice to the victims of the recent clashes in Aluthgama and Beruwela.
